Realtime Reporting

In normal circumstances (i.e. we have electricity, there are no computer malfunctions, etc.), Fraley Cooper "realtimes" every job.
The real question is, "What is the necessary/appropriate level of realtime reporting for me?"
Please consider the following scenarios in answering that question (also see related page "Rough Drafts") :
Level 1: The "Stenographic Court Reporter" has a laptop in front of them that has the realtime feed coming up on the screen in front of them. At any time during the proceedings, the reporter can quickly access prior testimony using key words and read back for you what was said, or the reporter will be happy to give you access to their laptop so you can see the testimony on the screen. Since, at Fraley Cooper, we routinely "realtime" every job, Level 1 is available on a regular basis. There are no prior arrangements necessary.
Level 2: The same scenario as above, with the exception that, instead of the reporter having the screen turned toward them, there is more of a "sharing" with you and you have more access to the reporter's computer screen. If, at any time during the proceedings, you decide you need more access to the computer, just let the reporter know; they will be happy to accommodate you. This level of realtime reporting is also routinely available on every job that Fraley Cooper reports, without any prior arrangements being made.
Level 3: You have a computer in front of you during the proceedings that has been furnished by Fraley Cooper, that has software preinstalled by us which allows you access to the proceedings in realtime. In addition to access, you can do things such as flag testimony, make notes. However, any flags/notes, will be available only during the proceedings. The court reporter has the ability to "refresh" the realtime feed on the computer you are using so as to eliminate things that did not properly translate originally. At the end of the day, while there is no copy of the proceedings that is available for you to take with you, we can provide you with a rough draft within a short time. The rough draft is complimentary when you order the transcript. This level requires prior notice to Fraley Cooper.
Level 4: You have Fraley Cooper hook up to your computer that has already had your own litigation-support software previously installed. You are then able to flag, make notes, etc., on your computer. When the proceedings are finished, your notes/flags, and the proceedings are saved for future use by you. This level of realtime reporting requires prior notice to Fraley Cooper.
There are several necessary caveats to the use of Level 4: (A) Fraley Cooper would want access to the computer you intend to use at the deposition ahead of time (at least the day before) to make sure any hookup issues are resolved before the deposition is scheduled to start. I am sure you have probably had the experience with a computer where things didn't go as smoothly as you would have liked. Having access beforehand allows Fraley Cooper time to deal with any of these issues and, if necessary, will allow our IT person and your IT person time to collaborate so that, when the deposition is scheduled to start, everything is running properly.
(B) With Level 4, if several parties wish to hook up to receive the realtime feed, if the parties are using different kinds of litigation-support software (i.e., LiveNote, Summation, etc.), there is a possibility that this can cause compatibility issues and will not allow the job to be realtimed to the parties' computers. In this case, we may have to revert to using the software that Fraley Cooper has pre-installed on its computers. Then, we can realtime the job to all computers. That is yet another issue that will need to be resolved ahead of time.
So, with Level 4, the solution is to allow us enough lead-time to take care of everything in order to ensure that you will be pleased with this service.
